<br />Agreement or contract shall mean a legal contract which complies fully <br />with the provisions of section 421 of the city's charter and this article. The words <br />agreement and contract may be used interchangeably in this article. <br /> <br />Electronic means electrical, digital, magnetic, optical, <br />electromagnetic, or any other similar technology. <br /> <br />Materials, supplies, labor and equipment shall mean those goods or <br />services, but excluding professional services and public works construction, that <br />are readily ascertainable and measurable by an objective standard in terms of <br />quantity or quality so as to be susceptible to competitive bidding. <br /> <br />Officers for purposes of these purchasing rules and regulations shall <br />mean the city manager, assistant city manager, the city attorney, the clerk of <br />the council and executive directors of various city agencies and departments. <br /> <br />Public Notice means the distribution or dissemination of information <br />to interested parties using methods that are reasonably available. Such <br />methods can include publication in newspapers of general circulation, <br />electronic or paper mailing lists, and web site(s) designated by the City of <br />Santa Ana and maintained for that purpose. <br /> <br />Professional ser/ices sh311 me3n the type of services that 3re provided by <br />accountants, appr3isers, 3rchitects, attorneys, 3uditors, construction m3nagers <br />(including progr3m or project m3nagers), engineers, educ3tors or te3chers, 13nd <br />surveyors, physici3ns, psychologists, financi31 pl3nners, urb3n pl3nners 3nd <br />other simil3r profession31, scientific, educ3tion31 or technic31 individuals or <br />org3nizations whose services are ch3r3cterized by a high degree of profession31, <br />scientific, educational, technical or otherwise speci31ized skill or expertise, not <br />re3dily susceptible to competitive bidding. <br /> <br />Purchasing manager shall mean that city employee or official so <br />designated by the city manager and authorized to carry out the responsibilities <br />under this article, including the promulgation and enforcement of administrative <br />procedures. <br /> <br />Purchase order (PO) shall mean that standardized contract developed <br />pursuant to subsection 2-8030) issued to the vendor of materials, supplies, labor <br />and equipment. <br /> <br />Services means the furnishing of labor, time, or effort by a <br />contractor, not involving the delivery of a specific end product other than <br />reports which are merely incidental to the required performance. Services <br />are of an advisory nature, provide a recommended course of action or <br />personal expertise, have an end product comprised of a transmittal of <br />information, written or verbal, and that is related to the governmental <br /> <br />Ordinance No. NS-XXX <br />Page 4 of 10 <br /> <br />50A-6 <br />
