2.1 APPLICABLE REGULATIONS <br />These provisions shall apply to all properties within the MEMU <br />Overlay Zone, but do not supersede the underlying zoning <br />districts. All new development within the MEMU Overlay <br />Zone will be subject to the requirements and improvements <br />required in the Metro East Public Realm Amenity Plan, which <br />is included as an Appendix. Definitions of terms not found <br />within the MEMO Overlay Zone are found within SAMC <br />Chapter 41, Article 1, Division 2. <br />2.2 CONTINUANCE OF DEVELOPMENT <br />RIGHTS USING UNDERLYING ZONING <br />DISTRICT STANDARDS <br />All regulations, development standards, and requirements <br />in the underlying zoning districts shall continue to apply to <br />those properties that are currently developed according to <br />the existing standards. New projects may also be developed <br />to the existing underlying zoning district provided that all <br />standards and requirements of the underlying zone are met. <br />2.3 OPTION TO APPLY THE MEMO OVERLAY <br />ZONE <br />Properties within the MEMU Overlay Zone may choose to <br />develop to the standards of the underlying zoning districts or <br />to the standards contained within this MEMU Overlay Zone. <br />in order to exercise the option to develop under the MEMU <br />Overlay Zone district, a MEMU Site Plan Review application <br />approved by the Planning Commission shall be required. In <br />granting such approval, the Planning Commission must find <br />that the proposed development is in compliance with the <br />provisions of the MEMU Overlay Zone and the Findings in <br />Section 8.2 of this code section. <br />In order to facilitate project and site design consistent with <br />the provisions of this MEMO Overlay Zone, any development <br />proposal for exercising use of the MEMU Overlay Zone shall <br />be designed so that any primary use within the development is <br />located within a newly constructed building. No primary use or <br />uses shall be located in a building that has been rehabilitated <br />or is otherwise the reuse of an existing building. <br />2.4 USE OF PHOTGRAPHS <br />Photographs are used liberally throughout this document <br />and are intended for illustrative purposes only. Specific <br />development standards and regulations contained in this <br />document are the controlling language for purposes of <br />development regulation. <br />11 A-20 <br />
