<br />Variance No. 2007-01 <br />March 26, 2007 <br />Page 5 <br /> <br />a commercial permit parking program as commercial land uses typically <br />generate parking intrusion problems in adjacent residential <br />neighborhoods that have in part, led to the Residential Permit Parking <br />Program. Under the residential permit parking program, ineligible <br />properties such as commercial establishments within a qualifying block <br />typically do not have the permit parking restriction placed along their <br />frontage. <br /> <br />Council establishes residential permit parking districts by resolution <br />in accordance with an existing ordinance and following a request from a <br />resident for permit parking. A qualifying request occurs when staff <br />verifies that 75 percent or more of the available on-street parking is <br />occupied (and driveways are also utilized) on a block-by-block basis. <br />If the block qualifies, City staff initiates the establishment of a new <br />permit parking district and then provides a permit parking petition for <br />each qualifying block. Permit parking is implemented on each block that <br />demonstrates through a city-verified petition that at least 66 percent <br />of the affected residential property owners on the block support permit <br />parking. <br /> <br />The speakers at the last Planning Commission public hearing were from <br />areas immediately east of the project, which are not within an <br />established permit parking district. Public Works will investigate the <br />resident's requests for permit parking and recommend permit parking if <br />their block meets the above conditions. <br /> <br />The second issue pertained to the outdoor storage and sales at the <br />facility and the applicants desire to modify proposed conditions. <br />Condition Nos. 9 and 10 of the variance restricts outdoor storage, sales <br />and equipment rental/leasing to select areas of the site. The applicant <br />agrees with the proposed conditions as they pertain to product sales and <br />storage, but would like to modify the conditions to allow equipment <br />leasing and rental within the secured parking area adjacent to the guard <br />shack and closer to the entrance of their facility. Staff has <br />conditioned the project so that leasing and rental of equipment can only <br />take place within the buildings or at the south side of Building "AU and <br />west side of Building "BU if exterior. Staff does not recommend the <br />applicant's modifications as the purpose of this condition is to keep <br />equipment rental, product storage, and product sales out of designated <br />customer parking areas. The conditions of approval will free up an <br />additional five parking spaces for customer use and will make it very <br />easy for code enforcement to enforce any violation of these conditions <br />if these activities occur in any customer parking areas. <br /> <br />31A-6 <br />
