C-7-0733 <br /> <br /> <br />BETWEEN <br /> <br /> <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br /> <br /> <br />AND <br /> <br /> <br />CITY OF SANTA ANA <br /> <br /> <br />THIS AGREEMENT is made and entered into this I ~ r+r day of Apy; \ <br /> <br />,2007, <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />6 <br /> <br />7 by and between the Orange County Transportation Authority, 550 South Main Street, P.O. Box 14184, <br />8 Orange, California 92863-1584, a public corporation of the state of California (hereinafter referred to <br />9 as "AUTHORITY"), and City of Santa Ana, a charter city and municipal corporation, organized and <br />10 existing under the Constitution and laws of the State of California (hereinafter referred to as "CITY"). <br /> <br />11 RECITALS: <br /> <br />12 <br /> <br />A. <br /> <br />AUTHORITY utilizes CITY streets for its public transportation program, including the <br /> <br />13 bus system. <br /> <br />14 <br /> <br />B. <br /> <br />AUTHORITY's busses have damaged two catch basins owned and maintained by the <br /> <br />15 CITY. <br /> <br />16 <br /> <br />C. <br /> <br />The parties have agreed that CITY will repair the damaged catch basin and <br /> <br />17 AUTHORITY shall reimburse CITY its actual costs to make such repair, in an amount not to exceed <br /> <br />18 Ten Thousand Dollars ($10,000.00). <br /> <br />19 WHEREFORE, in consideration of the mutual and respective covenants and promises, and <br /> <br />21 <br /> <br />20 subject to all the terms and conditions hereinafter set forth, the parties hereto agree as follows: <br /> <br />22 <br /> <br />1. <br /> <br />OBLIGATIONS OF CITY <br /> <br />a. <br /> <br />CITY shall select and pay a contractor to repair the catch basins, as set forth <br /> <br />23 in Exhibit A, attached to and, by this reference, incorporated in and made part of this reimbursement <br /> <br />25 <br /> <br />24 Agreement. <br /> <br />b. <br /> <br />CITY shall submit an invoice to AUTHORITY evidencing the cost of the repairs <br /> <br />26 paid by CITY. <br /> <br />Page 1 of 3 <br /> <br />MCT:MCT <br />L:\Camm\CLERICAL\CLERICAL\WORDPROC\AGREE\AG70733.doc <br />
