C-5-2592 <br />BETWEEN <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br />AND <br />CITY OF COSTA MESA <br />AND <br />CITY OF SANTA ANA <br /> <br />THIS AMENDMENT NO.1 is made and entered into this /qr~ay of ),a;e./ L <br />2006, by and between the Orange County Transportation Authority, 550 South Main Street, P.O. Box <br />14184, Orange California 92863-1584, a public corporation of the State of California (hereinafter <br />referred to as "AUTHORITY") and the City of Costa Mesa (hereinafter referred to as "COSTA MESA") <br />and the City of Santa Ana, (hereinafter referred to as "SANTA ANA"). <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />6 <br /> <br />7 <br /> <br />8 <br /> <br />9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />13 <br /> <br />RECITALS: <br /> <br />14 <br /> <br />WHEREAS, by Agreement No. C-5-2592, dated October 14, 2005, AUTHORITY, COSTA <br /> <br />15 <br /> <br />MESA, and SANTA ANA, in cooperation with the California Department of Transportation (hereinafter <br /> <br /> <br />referred to as "CAL TRANS"), pursuant to Streets and Highways Code Sections 114 and 130, mutually <br /> <br /> <br />agreed to cooperate in the development of improvements to Interstate 405 and State Route 55 <br /> <br /> <br />consisting of adding a High-Occupancy Vehicle (HOV) direct connector from the southbound State <br /> <br /> <br />Route 55 to northbound Interstate 405, and the reverse movement (referred to herein as <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br />"TRANSITWA Y PROJECT" or "MOS-3"); and <br /> <br /> <br />WHEREAS, AUTHORITY at the request of COSTA MESA included constructing a series of <br /> <br /> <br />local access improvements, (hereinafter referred to as "CITY OF COSTA MESA IMPROVEMENTS" or <br /> <br /> <br />"MOS-2"), along Interstate 405 in the same area of the MOS-3.
