EXHIBIT A <br />I. SCOPE OF SERVICES <br />A. Consultant will provide instruction in cheerleading basics including motion, <br />jumping, stunts, basic tumbling, fitness, conditioning and SPIRIT. Consultant <br />shall provide instruction, spotting and mats to protect participants. <br />B. Consultant will confer with City to set the time and location of the classes, <br />including days and hours of class and holidays to be observed. <br />C. Consultant will provide and be responsible for equipment, records, personnel and <br />clean up of the facilities and materials necessary to ensure the safety and <br />effectiveness of said instruction. <br />D. If Consultant allows others to teach classes, those teachers must be over 21, hold a <br />valid instructor rating and be covered by Consultant's insurance. <br />II. CLASS SIZE - REGISTRATION <br />A. The minimum number of participants is 8 per class. Maximum registration is 50 <br />participants per class. <br />B. No registration shall be accepted after the second week of classes. <br />C. In the event the minimum number of enrollees is not realized by the second week <br />of classes, the class shall be canceled and Consultant will be under no obligation <br />to provide services, and the City will be under no obligation to pay Consultant <br />compensation. <br />III. FEES <br />A. The fee to participants shall by $60.00 per 12 -week session per participant. <br />Students may purchase poms and uniforms through the instructor. <br />B. No refunds shall be made to participants unless class is canceled as set forth in <br />Section I1.C, above. <br />C. City shall register participants and collect said fees from each participant during the <br />registration period. City agrees to pay Consultant seventy percent (70 %) of the <br />total fees collected each month. City and Consultant agree that City shall retain <br />thirty percent (30 %) of the fees collected as an administration fee. <br />C. Consultant agrees that City representatives shall be entitled to audit Consultant's <br />records to insure compliance with this Agreement. <br />
