from his or her Bureau Commander, the grievance shall be barred and waived. <br />18.3 Formal Process. <br />A. If the grievance is not resolved through the informal process, and a written grievance <br />is filed within the time limits set forth above, the grievant's immediate supervisor <br />and Division Commander will add their comments and any justification they consider <br />proper, sign it, and forward it to their Bureau Commander without undue delay, or in <br />no case, more than seven (7) calendar days after receiving the formal grievance. A <br />copy shall be provided to the employee. <br />B. The Bureau Commander, after study of the case, shall attach his or her decision and <br />reasons therefore, and return them to the employee within seven (7) calendar days <br />after receipt of the written grievance. <br />C. If no satisfactory settlement has been reached at the division level, the employee may, <br />within seven (7) calendar days after receipt of the Bureau Commander's decision <br />may, in writing, request a meeting with the Police Chief to pursue the employee's <br />grievance. Failure of the grievant to take this action will constitute a waiver and bar <br />to the grievance, and the grievance will be considered settled on the basis of the <br />Bureau Commander's response. <br />D. If the grievant files a written grievance to the Police Chief in the matter and within <br />the time limits specified in "C" above, then a conference shall be held at the request <br />of the employee or the Police Chief. <br />E. The Police Chief shall inform the employee of his action within fourteen (14) <br />calendar days of the filing of the written grievance with the Police Chief or the date <br />the conference is held between the employee and the Police Chief. <br />F. If no satisfactory settlement has been reached at the departmental level, the employee <br />may, within seven (7) calendar days after being informed by the Police Chief of his <br />decision on the matter, and the reasons thereof, submit the grievance in writing to the <br />City Manager, or his duly authorized representative, for determination. Failure of the <br />grievant to take this action will constitute a waiver and bar to the grievance, and the <br />grievance will be considered settled on the basis of the Police Chief's response. <br />The City Manager, or his representative, after careful review, shall render a final <br />decision on the merits of the grievance, in writing, and return it to the grievant within <br />twenty-one (21) calendar days after receiving the grievance. A copy of the written <br />grievance to the City Manager, and of the City Manager's decision, shall be filed in <br />the Personnel Records of the department and the grievant's personnel jacket <br />maintained in the Personnel Services Department. <br />G. After the procedure set forth in this Article has been exhausted, the grievant, the <br />Association, and the City shall have all rights and remedies to pursue said grievance <br />under the law. <br />61 <br />
