<br />Variance No. 2007-01 <br />March 26, 2007 <br />Page 6 <br /> <br />The third issue involved the stoppage of trains on Fourth Street as they <br />approach the Santa Ana station. Staff contacted representatives from <br />Metrolink and the Burlington Northern Santa Fe (BNSF) railroad for <br />information. Metrolink does not have trains stopping on Fourth Street; <br />however, BNSF trains may occasionally need to stop for approximately 30 <br />seconds while the switching station south of Fourth Street is operating. <br />This should not interfere with vehicular traffic on Fourth Street as the <br />BNSF trains run only six times per day and normally at off peak hours. <br />Also, staff monitored the crossing on two occasions (8:00 to 9:30 a.m. <br />and 3:30 to 5:00 p.m.) on March 16, 2007 and didn't observe any trains <br />stopping on the tracks. <br /> <br />Finally, an issue was raised regarding day laborers congregating at the <br />si te. As a condition of the proj ect, "No Loi teringU signs will be <br />posted at the facility in conformance with California Penal Code ("CPCU) <br />Section 602. However, the Police Department would need to receive a <br />complaint from the property owner to enforce the "no loiteringU <br />provision. The project could be conditioned to require a private <br />security guard to prevent on-site loitering. It is likely, however, <br />that day laborers would find another location close to the site to <br />congregate. Other cities have required on-site hiring trailers with <br />restroom facilities to be provided. This alternative would require the <br />site plan to be modified to accommodate this alternative. It is likely <br />that some day laborers will use parking on the HD Supply site or in the <br />surrounding area while they seek work and that the City will experience <br />an increase in the number of day laborers that congregate on or near the <br />site if the proposed project is approved. <br /> <br />On March 20, 2007 a meeting was facilitated by City staff with <br />representatives of HD Supply, the property owner, and members of the <br />adj acent residential and industrial neighborhoods. The meeting topics <br />focused on those items discussed during the previously mentioned public <br />hearing and included concerns about parking intrusion into the <br />neighborhood, hours of operation and delivery, potential for additional <br />traffic on Santa Fe, Second and Third, potential for congregation of day <br />laborers, potential for noise and potential for trucks backing out onto <br />Fourth Street causing unsafe conditions and traffic delays. During the <br />meeting the representatives of HD Supply clarified their operations for <br />the neighbors in order to address their concerns about hours of <br />operation, deliveries, potential for additional noise, their strategy <br />for discouraging congregation of day laborers and the operation of the <br />truck delivery area.
