Po.V"Cc ') <br />WATER QUALITY ORDINANCE IMPLEMENTATION AGREEMENT <br />BETWEEN THE ORANGE COUNTY FLOOD CONTROL DISTRICT <br />AND THE C:ITY OF <br />Santa Ana <br /> <br />copy <br /> <br />AMENDMENT NUMBER ONE TO <br /> <br />- - - ---- ---- -~......... ..."...~.............. ......T....~T <br /> <br />~n'gM"i''(M''NL___ <br /> <br />Agreement No. D02 <br /> <br />~04 <br /> <br />1 <br /> <br />AMENDMENT NUMBER ONE TO <br /> <br />3 <br /> <br />fO <br /> <br />4 <br /> <br />WIT N E SSE T H <br /> <br />5 <br /> <br />WHEREAS, on April 14, 2003, WATER QUALITY ORDINANCE IMPLEMENTATION AGREEMENT NO. <br /> <br />6 <br /> <br />D02-104 (hereinafter referred to as ~AGREEMENTn) between the Orange County Flood <br /> <br />7 Control DistrLct, (hereinafter referred to as ~DISTRICT"), and the City of Santa Ana, <br /> <br />8 (h8reinafter referred to as "CITY"), sometimes COllectively referred to herein as "the <br /> <br />9 PARTIES, "was executed for a period of two (2) years. <br /> <br />10 <br /> <br />WHEREAS, SECTION 3(a) of AGREEMENT NO. D02-104 stipulates that the AGREEMENT is <br /> <br />11 <br /> <br />renewable for an additional three (3) years upon mutual agreement of the PARTIES as <br /> <br />memorialized in writing by the CITY and the Director of Public Facilities and <br /> <br />12 <br /> <br />Resources Department (PFRD), or her designee, on behalf of the DISTRICT. <br /> <br />13 <br /> <br />WHEREAS, SECTION 3(a), line 22 currently refers to the Director, Public <br /> <br />14 <br /> <br />Facilities and Resources Department, or her designee, and the title of that individual <br /> <br />15 has recently been changed to the Director, Resources and Development Management <br /> <br />16 Department (RDMD). <br /> <br />17 <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: <br /> <br />18 <br /> <br />1. Section 3{a) of AGREEMENT NO. D02-104 is hereby amended to read: <br /> <br />19 <br /> <br />~The term of this AGREEME~IT shall expire April 14, 2008.u <br /> <br />2. Any reference in the Agreement to "Director of Publ.ic Facilities and <br /> <br />20 <br /> <br />Resources Department (PFRD), or her designeeu is hereby amended to read <br /> <br />21 <br /> <br />"Director of Resources and Development Management Department (RDMD), or <br /> <br />22 <br /> <br />designee." <br /> <br />23 <br /> <br />3. Except as amended herein, all other terms, conditions and covenants of <br /> <br />24 <br /> <br />AGREEMENT NO. D02~104 remain unchanged and enforceable as originally seL <br /> <br />25 <br /> <br />forth. <br /> <br />26 <br /> <br />~ <br />
