A-2005-115-001 <br />INSURANCE NOT ON FILE <br />WORK MAY N2 PROCEED FIRST AMENDMENT TO <br />CLERK OF COUNCIL LANDSCAPE MAINTENANCE AGREEMENT <br />DATE; 6-11-07 <br />0: PR03C2)(c. Thoyn-W z) <br />THIS FIRST AMENDMENT TO AGREEMENT, is entered into on January 2, <br />2007, by and between Midori Gardens ("Contractor") and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into Agreement #A-2005-115, dated July 1, 2005, (hereinafter <br />"said Agreement") by which Contractor has provided landscape maintenance for the <br />City parks. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Services to clarify their intention that Contractor will provide <br />services for new landscaping of the City. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />Section 1, SCOPE OF SERVICES, shall be amended to include in Exhibit A, <br />Attachment 1, the new landscape by the Fire Station Trailer, as part of the standard <br />weekly maintenance at Centennial Park. <br />2. City agrees to pay, and Contractor agrees to accept as total payment for the additional <br />landscape maintenance at the Fire Station Trailer, $475.00 per month. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
