INSURANCE ON FlLE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRE8 <br />/0-/-07 - <br />CLEAKO <br />DATE; ~-//- o ~ s Gabran~ <br />FIRST AMENDMENT TO AGREEMENT <br />A-2005-126-01 <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on June 30, <br />2006, by and between Transportation Studies, Inc., a California corporation <br />("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ("City"). <br />RECITALS: <br />A. The parties entered into Agreement A-2005-126, dated June 6, 2005, (hereinafter <br />"said Agreement") by which Consultant has provided traffic counting and data <br />collection services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the term of said Agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />1. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br />"This Agreement shall commence on June 6, 2005 and terminate upon expenditure of <br />allocated funds. unless terminated earlier in accordance with Section 13, below." <br />2.
