THIRTY (30) YEAR LEASE <br />Folder: 1573-77 <br />THIS LEASE ("Lease") is made and entered into this day of , 19 , by and <br />between UNION PACIFIC RAILROAD COMPANY, a Delaware corporation (herein "Lessor"), and the City of <br />Santa Ana, Califomia, (herein "Lessee"). <br />A I <br />B I LEASE TERMS <br />PREMISES <br />The term "Premises" shall refer to the land and any improvements and facilities located thereon <br />(excluding Lessor improvements and facilities} at Santa Ana, California, as shown on the attached <br />two prints dated July 1, 1999, attached hereto both as Exhibit "A" and both made a part hereof. <br />This Lease shall take effect on August 1, 1999 ("Effective Date). <br />TERM <br />This Lease shall be for a term of thirty (30) years ("Lease Term") from Effective Date hereof. <br /> <br />The Premises shall be used solely and exGusively for a bike trail and landscaping. The landscaping <br />will be maintained by the Lessee and at a height not to exceed three (3) feet tall, nor, at any time, <br />allowed to grow within ten (10) feet of any signal facility. <br />RE T <br />Commencing as of the Effective Date hereof, Lessee shall pay to Lessor aone-time payment of <br />One Hundred And Twenty Thousand Dollars ($120,000), payable in advance. <br />PROOF OF INSURANCE <br />On or before the execution of this Lease, Lessee shall furnish to Lessor proof of insurance as <br />required under Section 8 of the General Lease Terms, and the effective date of insurance coverage <br />shall be no later than the Effective Date of this Lease. <br />Document 0011 <br />Page 1 of 20 <br />
