<br />. . <br /> <br />A-2000-064-04 <br /> <br />INSURANCE MQI ON Fl~~ <br />WORK MAY t:m PROCEEO <br />CLERK OF COUNCIL <br />DATE: '1-6- 07 <br /> <br />AMENDMENT TO UNITED INSPECTION <br />AND TESTING CONSULTANT AGREEMENT <br /> <br />THIS FIFTH AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this 1st day of June 2007, by and between United Inspection & Testing, Inc., a Delaware <br />corporation ("Consultant") and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Consultant Agreement A-2000-064 dated April 17,2000, <br />(hereinafter "said Agreement") by which Consultant has provided material testing and <br />construction inspection services. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement to the time allocated funds have been expended. <br /> <br />WHEREFORE, in consideration ofthe covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br /> <br />"This Agreement shall commence on April 17, 2000 and terminate on expenditure of <br />allocated funds, unless terminated earlier in accordance with Section 12, below." <br /> <br />II <br /> <br />II <br /> <br />II <br /> <br />II <br /> <br />II <br /> <br />II <br />
