Reasonable effort was expended by the COVERED PARTY to terminate the <br />as soon as conditions permitted. <br />However, nothing contained in this provision shall operate to provide any coverage <br />with respect to: <br />(1) Any site or location principally used by the COVERED PARTY or by others on <br />the COVERED PARTY's behalf, for the handling, storage, disposal, dumping, <br />processing or treatment of waste material; <br />(2) Any fines or penalties; <br />(3) Any clean up costs ordered by the superfund program, or any federal, state or <br />local governmental authority. However this specific exception shall not serve <br />deny coverage for third party clean up costs otherwise covered by this <br />MEMORANDUM simply because of the involvement of a governmental <br />authority; <br />(4) Acid rain; <br />(5) Clean up, removal, containment, treatment, detoxification or neutralization of <br />POLLUTANTS situated on premises the COVERED PARTY owns, rents or <br />occupies at the time of the actual discharge, dispersal, seepage, migration, rele <br />or escape of said POLLUTANTS; or <br />(6) Water pollution caused by oil or its derivatives. <br />b. DAMAGES caused by heat, smoke or fume from a hostile fire. A hostile fire means one <br />becomes uncontrollable or breaks out where it was not intended to be; <br />a Firefighting activities, including training fires, or intentional ignition of fires for the purl <br />of limiting a fire, or to the discharge of POLLUTANTS for the purpose of controlling a <br />d. Police use of mace, oleoresin capsicum (O.C. or pepper gas), or tear gas; <br />e. Weed abatement, tree spraying or sudden and accidental sewer backups. <br />f Use of chlorine for domestic water, swimming pools or other routine sanitation. <br />2. Governmental orders, directions or requests that the COVERED PARTY test for, monitor, <br />up, remove, remedy, contain, treat, detoxify or neutralize POLLUTANTS. <br />3. A governmental unit or other third party's loss or expenses, including attorney fees, for efforts <br />monitor, clean up, remove, remedy, contain, trace, detoxify or neutralize POLLUTANTS. <br />4.
