<br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />DuChesne & Associates, LLC will perform consulting services relating to an independent <br />confidential internal affairs investigation as directed by the Santa Ana Chief of Police. <br /> <br />Consultant LLC (Loren W. DuChesne) is retained by the City of Santa Ana and the Santa Ana <br />Police Department for the following services. <br /> <br />1. Review and analyze existing case files, documents and evidence; <br /> <br />2. Meet with City of Santa Ana Police Department personnel, other authorized City of Santa <br />Ana representatives and their legal counsel as requested or required. <br /> <br />3. Interview witnesses and subjects; <br /> <br />4. Analyze facts and evidence; <br /> <br />5. Prepare written reports detailing findings, conclusions and recommendations. <br /> <br />6. Present oral and written information confidentially to City of Santa Ana Chief of Police, <br />authorized City of Santa Ana representatives, or their legal counsel; <br /> <br />7. Provide testimony at subsequent hearings or legal proceedings as necessary. <br /> <br />This investigation, when involving sworn peace officers, is to be conducted in accordance with <br />the provisions of The Public Safety Officers Procedural Bill of Rights Act (Government Code <br />Sections 3300-3311), and prescribed internal affairs processes established within the Santa Ana <br />Police Department. <br /> <br />Should Loren W. DuChesne and/or Duchesne and Associates, LLC be named as a defendant in a <br />lawsuit arising from this agreement/contract, the City of Santa Ana will defend and indemnify <br />Loren W. DuChesne and/or DuChesne and Associates, LLC to the same extent that it would be <br />required to do so for a full time employee of the City of Santa Ana, following the requirements <br />of Government Code Section 825. In other words, the City of Santa Ana will defend and <br />indemnify unless the conduct that gives rise to the law suit involves actual fraud, corruption or <br />malice. <br /> <br />Compensation for services will be at S85.00 per hour for all work and travel, plus $165.00 a day <br />per diem for food and lodging, if overnight lodging is required or is more cost effective for the <br />City of Santa Ana than compensating daily commutes during peak traffic intervals, plus <br />reasonable expenses incurred during the assignment, including mileage at $0.49 per mile travel. <br /> <br />1 <br />
