Section 827, and all applicable statutes, court orders and case law. No access, <br />disclosure or release of such information shall be permitted except as authorized. If <br />authorization is in doubt, no such information shall be released without the prior <br />approval and consent of the Judge of the Juvenile Court. <br />15.3 "Juvenile record information" is understood to include all records and data which <br />identify the subject of the information, and associate the subject with any aspect of <br />the administration of the Juvenile Court law of the State of California. Such <br />information includes, but is not limited to, the subject's offense history, social <br />history, all information of a diagnostic or evaluative nature, and any other personal <br />or confidential data which can be traced to the individual, whether generated by <br />SANTA ANA or not. <br />15.4 All written materials pertaining to the Juvenile Probationers shall be placed in a <br />secure and locked file when not in use, and access to such materials shall be limited <br />to specified authorized staff. <br />16.0 MUTUAL INDEMNIFICATION <br />COUNTY shall indemnify, hold harmless and defend SANTA ANA, its governing board, <br />officers, agents and employees from any and all claims, demands, losses or liabilities for <br />injury, death or damage arising out of the acts or omission to act by COUNTY agents or <br />employees in carrying out this Agreement. <br />SANTA ANA shall indemnify, hold harmless and defend COUNTY, its officers, agents <br />and employees, from any and all claims, demands, losses or liabilities for injury, death or <br />damages arising out of the acts or omission to act by SANTA ANA agents or employees in <br />carrying out this Agreement. <br />17.0 TERMINATION <br />17.1 Either party may terminate this Agreement, with or without cause, upon thirty- (30) <br />calendar days' written notice given to the other party. <br />17.2 In the event of termination of this Agreement, SANTA ANA and COUNTY shall <br />not be liable for services provided beyond the date of termination, except as may <br />otherwise be provided in this Agreement. <br />17.3 The obligations pertaining to indemnification for, or defense of, causes of action <br />accruing during the term of this Agreement, shall extend beyond the termination of <br />this Agreement until fully performed. <br />17.4 Notwithstanding anything contained in this Agreement to the contrary, in the event <br />no funds or insufficient funds are appropriated and budgeted or otherwise <br />unavailable in the budget for COUNTY by any means whatsoever in any fiscal year <br />covered by this Agreement, COUNTY will immediately notify SANTA ANA of <br />such occurrence, and this Agreement shall terminate after the last day during the <br />fiscal year for which appropriations shall have been budgeted for COUNTY. <br />Page 12 of 14 <br />
