CITY OF SANTA ANA <br />OFFICE OF THE CITY ATTORNEY <br />MEMORANDUM <br />To: Honorable Mayor and Councilmembers <br />;t+roni: Joseph W. Fletcher, City Attorney <br />gate: April 23, 2007 <br />Re: Settlement Agreement -Tustin Metro East <br />=s_: City Manager, Asst. City Manager, Planning Director <br />am pleased to report that we have reached agreement with the City of Tustin on settlement of <br />their objections to the Metro East EIR. The final settlement, attached to this memo, calls for <br />Tustin to agree to forego any challenge to the Metro East EIR [and therefore the Cabrillo Towers <br />Project] in exchange for Santa Ana's agreement to extend the Santa Ana -Tustin TSLA Joint <br />Powers Agreement in the Metro East area. <br />The TSIA fees will be used to conduct supplemental traffic studies in Tustin to determine if the <br />I <br />ong-term buildout of the Metro East Plan will have any unforeseen impacts. If:so, we will use <br />traffic fees from Metro East to pay Santa Ana's fair share of those impacts. The TSIA JPA <br />board will approve the final scope of the studies and the specific improvements. <br />Tustin and Santa Ana expect to complete those studies in less than six months. In the meantime, <br />Santa Ana has agreed not to approve any other Metro East projects utilizing the Metro East EIR. <br />According to Planning, there is only one project in the entitlement pipeline which is far enough <br />away from approval to avoid any problems. <br />THIS DOCUMENT IS CONFIDENTIAL AND SUBJECT TO T HE ATTORNEY CLIENT AND/OR <br />ATTORNEY WORK PRODUCT PRIVILEGES. <br />DISCLOSURE OF THIS DOCUMENT OR THE CONTENTS THEREOF MAY BE A VIOLATION OF <br />LAW. <br />
