<br />.. <br /> <br />INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />ClERK OF COUNCIL <br />DATE' 8'-'-07 <br />0: C.M/Chbfiek Lome\i <br />('/.) <br /> <br />A-2006-290-01 <br /> <br />FIRST AMENDMENT TO <br />MAIN STREET ARCHWAY SIGN <br />COOPERATIVE AGREEMENT <br /> <br />THIS FIRST AMENDMENT is entered into this .2.. day ofJuly, 2007, by and between <br />the COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, a public <br />body corporate and politic (the "Agency"), and the CITY OF SANTA ANA, a charter city and <br />municipal corporation duly organized and existing under the Constitution and laws of the State of <br />Califomia (the "City"). <br /> <br />WITNESSETH <br /> <br />A. The Agency and City entered into that certain agreement titled the "Main Street <br />Archway Sign Public Improvements Cooperative Agreement" ("Agreement") on or about November <br />_, 2006. <br /> <br />B. The Agency contracted with the City for the City to provide for the manufacturing <br />and installation in the South Main Project Area of public improvements Projects which, in this case, <br />will consist of the Main Street Archway Sign (referred to hereinafter as "Publicly Owned <br />Improvements") in connection with the Agency's redevelopment activities. <br /> <br />C. The Agency agreed to pay all or part ofthe value of the land for and/or the cost of <br />the manufacture and installation of such Publicly Owned Improvements to the City. <br /> <br />D. The parties hereto now want to amend the Agreement to increase the amount of the <br />compensation by the Agency due to unforeseen additional costs. <br /> <br />WHEREFORE, in consideration ofthe mutual and respective promises hereinafter <br />contained and made, and subject to all the terms and conditions of said Agreement as hereby <br />amended, the parties do hereby agree as follows: <br /> <br />1. The "SCOPE OF WORK" section of the Agreement shall be amended to increase the dollar <br />amount by an additional $75,540 in order to cover the costs to the Southem California Gas Company <br />for the relocation of a 3-inch gas main line to accommodate the sign post footing. Therefore, the <br />total compensation by the Agency to the City shall not exceed $383,645. City shall forward payment <br />to the Southern California Gas Company for said pipe relocation costs. <br /> <br />2. All other terms and conditions included in said Agreement shall have the same force and <br />effect and remain unchanged. <br /> <br />1 <br />
