CONFLICT OF INTEREST <br /> <br />Pursuant to the conflict of intcrcst rcquirements set forth in 24 CFR 576.57 and OMB <br />Circulars I - I 02 and A- I 10, SUBRECIPIENT agrccs that no officcr, employee, Rgent or assignee of <br />CITY having dircct or indircct control of any CDBG monics grantcd to the CITY, inclusivc of thc <br />subjcct CDBG FUNDS, shall scrvc as an officer of SUBRECIPIENT. Furthcr, any conflict or <br />potcntial conflict of intcrcst of any officcr of SUBRECIPIENT shall bc fully discloscd in writing <br />prior to the cxccution of this Agrccmcnt and said writing shall bc attachcd and dccmcd fully <br />incorporatcd as a part hcrcof. Notice shall bc scnt by SUB RECIPIENT to CITY rcgarding any <br />changcs or modifications to its board of dircctors and list of officcrs. <br /> <br />V. SPECIAL CERTIFICATION FOR RELIGIOUS ENTITIES <br /> <br />If SUBRECIPIENT is a religious cntity, SUBRECIPIENT hcrcby agrccs that in conncction <br />with thc provision of thc scrviccs SUBRECIPIENT shall providc with CDBG funds, in accordancc <br />with 24 CFR 570.200U): <br /> <br />A. SUBRECIPIENT shall not discriminatc against any cmploycc or applicant for <br />cmploymcnt on thc basis of rcligion and shall not limit cmploymcnt or givc prcfcrcncc in <br />cmploymcnt to pcrsons on the basis of rcligion. <br /> <br />B. SUBRECIPIENT shall not discriminatc against any pcrson applying for thc scrviccs <br />SUB RECIPIENT agrccs to provide undcr thc tcrms of this Agreemcnt on the basis of religion and <br />shall not limit such scrviccs or givc prcfercncc to applicants for such scrvices on the basis of <br />religion. <br /> <br />C. SUBRECIPIENT shall NOT providc religious instruction or counscling, conduct <br />any rcligious worship or serviccs, or cngage in any religious proselytizing, or cxcrt any rcligious <br />influcnce in thc provision of the services in said program. The parties agrec that this covcnant is <br />intcndcd to and shall be construcd for thc limited purpose of assuring compliance with respect to the <br />usc of CITY funds by SUB RECIPIENT with applicablc constitutional limitations respecting thc <br />cstablishment of religion as sct forth in thc establishmcnt clausc under the First Amendment of thc <br />Unitcd Statcs Constitution and Articlc I, Scction 4 of the California Constitution, and is not in any <br />manncr intcndcd to restrict othcr activitics of SUBRECIPIENT. <br /> <br />9 <br />
