B. When labor compliance problems are discovered by the Construction Manager, Program <br />Manager will require that they be reported to the City. The City is responsible for <br />determining the appropriate action required to remedy or address the problem. When labor <br />compliance problems are discovered by process review they should be documented in the <br />process review report with a recommendation for correction of the problem. <br />18.1.2 Record Keeping_ The Construction Manager must maintain sufficient records to <br />ensure each Contractor's compliance with wage and apprenticeship sections of the Agreement. <br />ARTICLE 19 <br />19.1 Assignment <br />Neither this Agreement nor any part thereof shall be assigned by the Program Manager <br />without prior written consent of the City. <br />19.2 Amendments to the Agreement <br />Amendments to the Agreement must be in writing and approved by both parties before they <br />become effective. <br />19.3 Conflicts in Documents <br />In the event of conflict between the terms set forth in the Agreement and any Exhibits, the <br />provisions listed in the Agreement shall control. <br />ARTICLE 20 <br />20.1 NOTICE <br />Any notice, tender, demand, delivery, or other communication pursuant to this Agreement <br />shall be in writing and shall be deemed to be properly given if delivered in person or mailed by first <br />class or certified mail, postage prepaid, or sent by facsimile or other telegraphic communication in <br />the manner provided in this Section, to the following persons: <br />To the City: Clerk of the City Council <br />The City of Santa Ana <br />20 Civic Center Plaza (M-30) <br />P.O.
