<br /> <br />A-2000-064-05 <br /> <br />NSURANCE ON FILE <br />ORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />'I-/-og <br />CLERK OF COUNCIL <br />DATE: AUG 3 1 '2007 <br />: PWA" CoY'\S'\1u:i\ch(2) <br />~I K~ G;\r.9~ <br /> <br />AMENDMENT TO UNITED INSPECTION <br />AND TESTING CONSULTANT AGREEMENT <br /> <br />THIS SIXTH AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this ih day of August 2007, by and between United Inspection & Testing, Inc., a <br />Delaware corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br />RECIT ALS: <br /> <br />A. The parties entered into Consultant Agreement A-2000-064 dated April 17, 2000, <br />(hereinafter "said Agreement") by which Consultant has provided material testing and <br />construction inspection services. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Compensation amount pursuant to the terms of said Agreement. to the time <br />allocated funds have been expended. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2, subsection b. of the COMPENSATION clause of said Agreement states as <br />follows: <br /> <br />" If Consultant is authorized in writing by the City's Executive Director of the Public <br />Works Agency to perform additional services, Consultant shall be compensated at <br />hourly rates and unit costs in accordance with Exhibit C; provided, however, that <br />such additional services plus original services shall not exceed Three Hundred Sixty <br />Thousand Two Hundred Fifty Dollars ($360,250.00)." <br /> <br />2. The Executive Director hereby authorizes Consultant to perform such additional <br />services at the rates set forth in Exhibit C of said Agreement, thereby increasing the <br />Compensation to an amount not exceed Three Hundred Sixty Thousand Two <br />Hundred Fifty Dollars ($360,250.00). <br /> <br />3. All other terms and conditions as set forth in the original Agreement and all <br />Amendments thereto, shall remain in full force and effect. <br />
