�r <br />N -2006- 037 -03 <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />10,4-42 THIRD AMENDMENT TO AGREEMENT <br />CLERK OF COUNCIL <br />DATE: 9 -6'07 <br />c <br />Ggb 0 Y Lome), el, THIS THIRD AMENDMENT TO AGREEMENT is entered into on July 31, <br />2007, by and between DISPLAY CITY, INC., a California corporation ( "Consultant ") <br />and the City of Santa Ana, a charter city and municipal corporation of the State of <br />California ( "City "). <br />RECITALS: <br />A. The parties entered into Agreement N -2006 -037, dated May 1, 2006, (hereinafter <br />"said Agreement ") by which Consultant has provided tree lighting maintenance for <br />the Artist Village Tree Lighting Program. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Service, increase compensation to pay for new services and <br />extend the term of said Agreement for an additional six -month period. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Third Amendment to Consultant Agreement, the parties agree as follows: <br />Section 1, SCOPE OF SERVICES, shall be amended to include the installation of 50 <br />banners on light poles in downtown Santa Ana, as set forth in Exhibit A -3, attached <br />hereto and incorporated by this reference. <br />2. Section 2.a., COMPENSATION, shall be increased by $5,000.00 for a total amount <br />not to exceed $20,000.00 during the term of said Agreement. <br />3. Section 3, TERM, shall be amended to extend the termination date to June 30, 2008. <br />4. Except as herein amended, all terms and conditions of said Agreement shall <br />remaining full force and effect. <br />// <br />// <br />
