PBA (2.") <br />TOl1\a '2.e~~ THIS AMENDMENT (Amendment), made and entered into this 29 day of May, 2007, by <br />and between ELIZABETH MOULE & STEF ANOS POL YZOIDES, ARCHITECTS AND <br />URBANISTS, a California corporation (hereinafter "Consultant") and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California, (hereinafter "CITY"). <br /> <br />N-2007-101 <br /> <br />Amendment to Standard Consultant A2reement <br /> <br />RECITALS: <br /> <br />A. The parties entered into that certain agreement entitled "Standard Consultant Agreement" <br />dated the February 27,2006, hereinafter referred to as "said Agreement." <br /> <br />B. The Parties hereto desire to amend the "Scope of Services" and "Compensation" sections <br />of said Agreement, in order to incorporate the additional activities as set forth in Exhibit B3 <br />to this Amendment. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />hereinafter contained and made, and subject to all of the terms and conditions of said <br />Agreement as hereby amended, the parties hereby agree as follows: <br /> <br />1. The first paragraph of said Agreement is hereby amended to add additional services <br />as set forth in Exhibit B3 to this Amendment. <br /> <br />2. The second paragraph of said Agreement is hereby amended to add an additional <br />$9,100 in compensation to Consultant such that it reads as follows: <br /> <br />"The City agrees to pay, and Consultant agrees to accept as total payment for its <br />services, those rates and charges identified in the Consultant's Fee Proposal, <br />attached hereto as Exhibits B 1, B2 and B3 to this Amendment, but shall include a <br />contingency of $48,865 under said Agreement and an additional contingency of <br />$26,243 under the 1 st Amendment, dated June 27, 2006. The total sum to be <br />expended under said Agreement shall not exceed $1,082,100 during the term of said <br />Agreement, of which $569,781 has been spent as of AprilS' 2007. The total sum of <br />$1,082, I 00 includes both the rates and charges in Exhibit B 1, B2, and B3 to this <br />Amendment, and the rates and charges identified in the Consultant's Fee Proposal, <br />attached as Exhibit B to said Agreement." <br /> <br />3. Except as hereinabove modified, the terms and conditions of the Agreement <br />remain in full force and effect. <br />
