Sf-I? 1,<\ 'Z.GG7 <br />0', pWA (l, <br />Ie"" Cc..'o '.E. <br /> <br />A-2007-171 <br /> <br />FIRST AMENDMENT TO <br />TmRD AMENDED AND RESTATED AGREEMENT FOR <br />COLLECTION AND HANDLING OF SOLID WASTES <br /> <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on June 18, <br />2007, by and between USA Waste of California Inc., a Delaware corporation dba Waste <br />Management of Orange County ("Contractor") and the City of Santa Ana, a charter city <br />and municipal corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement #A-2006-071, dated April 3, 2005, (hereinafter <br />"said Agreement") by which Consultant has provided solid waste collection and <br />transportation services within the corporate limits of Santa Ana. <br /> <br />B, Since the inception of said Agreement, Contractor and City have jointly agreed to <br />implement two new programs - the household hazardous waste collection program, <br />and the medical sharps collection program. <br /> <br />C. In order to pay for these new services, it is necessary to increase the rates which <br />Waste Management charges for its curbside collection services. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 13, SERVICES TO BE PROVIDED BY CONTRACTOR TO CITY FOR <br />CITY OPERATIONS, shall be amended to include additional services by adding a <br />paragraph 13 (d) and 13 (e) to read as follows: <br /> <br />"(d) The CONTRACTOR shall coordinate with the Executive Director to provide <br />household hazardous waste collection events allowing residents to deliver their <br />waste to a collection site for proper disposal by CONTRACTOR. <br /> <br />(e) The CONTRACTOR shall administer a Residential Mail-Back Service, <br />providing containers approved for safe disposal of used medical sharps by <br />residents, When the container is full, the resident will mail it for incineration <br />at an authorized facility. This program will be offered to residential customers <br />who, for medical reasons, require the use of medical sharps," <br /> <br />2, Exhibit "C", section 1, "CURBSIDE SERVICE" shall be deleted and replaced with <br />the following: <br />
