The Parties entered License Agreement #A-2004-259, dated April 28, 2005, hereinafter referred to as "said Agreement", to provide healthy snacks and beverage concessions in various identified locations in City Parks. B. The Parties desire to extend the Term of said Agreement for an additional one-year term. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those hereby amended, the parties agree as follows: I, Section 3, of said Agreement, "Term of License" shall be amended to renew the term of said Agreement for the third additional one-year term, through October 28, 2008. 2. Except as hereinabove modified, the terms and conditions of said Agreement, as previously amended, shall remain in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the date and year first above written.
