<br />. <br /> <br />INSURANCE tillI ON FILE <br />WORK MAY tm PROCEED <br />CLERK OF COUNCIL <br />DATE: OCT 1 6 2007 <br />o. coA (0) \, <br />. ~c.b.t /... t> 'YY\ ~ I <br /> <br />N-2007 -118 <br />DO NOT RECORD <br /> <br />LEASE AGREEMENT <br />BETWEEN THE <br />CITY OF SANTA ANA AND <br />JAVIER AND MILENA MARIN <br />dba EL FAISON <br /> <br />THIS AGREEMENT ("Agreement") is made and entered into this ~ day of <br />tXi ' 200 L, by and between the City of Santa Ana, a charter city and municipal <br />corpo ation, duly orgamzed and eXItmg under the constItutIOn and laws of the State of <br />California, herein referred to as "Landlord", and Javier and Milena Marin, doing business <br />as "El Faison", herein referred to as "Tenant". <br /> <br />The parties hereto agree as follows: <br /> <br />ARTICLE 1 - TERM OF LEASE <br /> <br />Section 1.01 Premises and Use <br /> <br />(a) Landlord owns the real property located at 321 E. Fourth Street, Santa Ana, <br />California (the "Premises"). Landlord hereby rents to Tenant sole use ofthe <br />Premises for Tenant's business purpose of providing Mexican imported <br />novelties, western wear, goods and services. Tenant shall have the right to <br />alter the Premises, at Tenant's sole cost, subject to Landlord's prior approval, <br />which shall not be unreasonably withheld. Tenant's modifications shall to <br />comply with all local permit requirements. <br /> <br />(b) Tenant's use ofthe Premises shall be comprised of the normal business hours <br />of Monday through Sunday. <br /> <br />(c) Tenant hereby accepts the Premises in their condition existing as of the <br />Commencement Date of this Agreement. Tenant shall maintain the Premises <br />in a clean condition, compatible with the architectural style of the Fiesta <br />Marketplace. <br /> <br />(d) Any signage Tenant intends to place upon the Premises is subject to prior <br />approval of the Landlord, and must be compliant with City of Santa Ana local <br />regulations. <br /> <br />(e) Upon the expiration or termination of this Agreement, Tenant shall surrender <br />the Premises to Landlord in good and clean condition, less ordinary wear and <br />tear. <br />
