SECTION 49: That section 14-1 of the Santa Ana Municipal Code is hereby <br />amended such that it reads as follows: <br />Sec. 14-1. Adoption of the International Fire Code, 2006 Edition, and the California Fire <br />Code, 2007 Edition. <br />There is hereby adopted by the City of Santa Ana that certain code known as the <br />"International Fire Code, 2006 Edition and the California Fire Code 2007 Edition," and <br />the whole thereof including the Appendices therein, errata issued during and after the <br />publishing date, save and except such portions as are hereinafter deleted or amended, <br />of which code not less than one (1) copy has been and is now on file in the office of the <br />Clerk of the Council of the City of Santa Ana pursuant to Health and Safety Code <br />Section 18942(d)(1) and are made available for public inspection. The said code is <br />adopted and incorporated as fully as if set forth at length herein and, subject to all <br />amendments set forth in this article, shall be in effect within the City of Santa Ana from <br />the effective date of this article. Any provision of this article amending the above <br />mentioned codes shall be construed as amending the 2006 and 2007 editions thereof <br />including such provisions enacted prior to this adoption of the said 2006 and 2007 <br />editions and not thereafter repealed. The said International Fire Code, 2006 edition and <br />the California Fire Code 2007 edition, as thus amended, together with all other <br />provisions of this article, shall be known as the "Fire Code of the City of Santa Ana". <br />SECTION 50: That section 14-18 of the Santa Ana Municipal Code is hereby <br />amended such that it reads as follows: <br />Sec. 14-18. Board of Appeals (Section 108). <br />Section 108 of the California Fire Code is amended to read as follows: <br />The planning commission shall have the power and be required to hear appeals <br />regarding the fire marshal's denial of, or refusal to grant, any application for a permit <br />required under any provision of the fire code, the determination of the suitability of <br />alternative materials and types of construction, and the reasonable interpretation of the <br />provisions of the fire code in the event of a dispute occurring in the permit application <br />process. Any such appeal shall be filed with the secretary for the planning commission. <br />SECTION 51: The City Council of the City of Santa Ana hereby finds, <br />determines and declares that adoption of section 14-21 amending California Fire Code <br />section 202, Definition of High-Rise Structure is necessary due to the climatic and <br />geographic conditions of high winds and low humidity. This combination of events <br />creates an environment that is conducive to rapidly spreading fire. Control of such fire <br />requires rapid response. Obstacles generated by a strong wind, such as fallen trees, <br />street lights and utility poles, and the requirement to climb 75 feet vertically up flights of <br />stairs will greatly impact the response time to reach an incident scene. Moreover, this <br />area has been designated as the highest seismic risk zone in the hierarchy that rates <br />Ordinance No. NS-XXXX <br />11 B-23 Page 23 of 37 <br />
