Variance No. 2007-10 has been filed with the City of Santa Ana seeking to <br />reduce the landscaping from the required twenty (20) feet to five (5) feet <br />as required by Section 41-434 of the Santa Ana Municipal Code. <br />Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a variance upon making certain findings. <br />i. That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location <br />or surroundings, that the strict application of the zoning <br />ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of this Chapter. <br />There are special circumstances applicable to the <br />subject property. The subject site is aself-contained <br />site surrounded by existing residential uses. The <br />setback reduction is necessary due to the existing <br />configuration of the site and the need to maintain <br />adequate parking on the premises. <br />ii. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial <br />property rights. <br />The granting of the variance will preserve the property <br />owner's ability to utilize a property that has been <br />vacant since 2001 with a use that is less intense than <br />the previous use and is consistent with the intent of <br />the Single-Family Residential zoning district. <br />iii. That the granting of a variance will not be materially <br />detrimental to the public welfare or injurious to surrounding <br />property. <br />The granting of the variance will not be materially <br />detrimental to the public welfare or injurious to <br />surrounding properties as the project has been <br />designed to preserve the character of the surrounding <br />neighborhood.
