ReQuirement for analysis ai <br />on housing for persons with disabilities and an action program <br />addressing those constraints. <br />AB 1866. Analysis of second -unit ordinance to ensure <br />compliance with state law with respect to development standards <br />and administrative approval processes. <br />AB 2348. Documentation of the appropriateness of zoning, <br />density, and development standards to facilitate affordable <br />housing for very low and low income households. <br />Should actual governmental constraints be identified, the Housing <br />Element must contain programs to mitigate or remove actual constraints <br />to housing, to the extent feasible and legally possible. <br />Our experience indicates that the Department of Housing and <br />Community Development will look at three specific potential <br />governmental constraints —land use capacity, tenure of housing <br />production, and the discretionary permitting process (e.g., whether or <br />not housing is expressly or conditionally permitted) —as potential <br />barriers to affordable housing. If any of these regulations is deemed a <br />constraint, programs must be devised to mitigate its impact. <br />Environmental and Infrastructure Constraints <br />The Housing Element will contain a current discussion of water, sewer, <br />and transportation constraints to the production, maintenance, and <br />improvement of housing. The General Plan EIR for the 1998 Land Use <br />Element will provide a program -level analysis. The Housing Element will <br />likely rely on a combination of sites for housing already proposed in <br />existing development projects or in approved Specific Plans. We will <br />reference each of the EIRs for each development project to document <br />adeQuacy of infrastructure constraints to development. <br />This analysis will also be folded into the environmental documentation <br />reQuired to clear the Housing Element pursuant to CEQA. <br />Housing Element Update THE PLANNING CENTER I Page 2-S <br />
