To be considered, all proposals must be completely <br />responsive to the RFP. <br />X. <br />XI <br />XII. <br />ACCEPTANCE OF CONTRACT <br />The contents of the proposal of the successful proposer shall become contractual <br />obligations ~if a contract ensues. Failure of the consulting firm to accept the <br />obligations will result in cancellation of the award, and the resulting damage <br />accrued by the City may be recovered from the consulting firm. <br />A copy of the City's standard consulting agreement is included in Appendix B for <br />the proposer's information. <br />DISCLOSURE <br />If there is any information that the proposer does not wish to disclose, other than <br />for the purpose of evaluation, the proposer should have .each applicable sheet or <br />part marked "Confidential". This data shall not be disclosed or duplicated, used or <br />disclosed in whole or in part for any purpose other than to evaluate the response. <br />However, in case that a contract is awarded to the proposer, the City shall have <br />the right to duplicate, use or disclose this in-formation to the extent provided in the <br />contract. This restriction will not limit the City the right to use information if it is <br />obtained from another source. <br />RULES FOR PROPOSAL <br />The signer of the proposal must declare in the aforementioned cover letter that the <br />only person, persons, company or parties interested in the proposal as principals, <br />are named therein; that the proposal is made without collusion with any other <br />person, persons, company or parties submitting a proposal; that it is in all respects <br />fair and in good faith without collusion or fraud, and that the signer of the proposal <br />has full authority to bind the proposing firm. <br />1. PROPOSALS TO BE SUBMITTED SHALL CONTAIN THE FOLLOWING <br />INFORMATION: <br />A. Credentials of the firm. Provide a synopsis of the firm's qualifications, <br />experience and capacities in connection with the proposed services. <br />Clearly state what services are to be performed. <br />B. List of quality control projects completed by the firm. List names, <br />locations, brief description of the projects and the firm's involvement, <br />including types of testing and inspection for which the firm was <br />responsible. <br />- 7 - <br />25K-18 <br />
