REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />JANUARY 7, 2008 <br />TITLE: <br />AGREEMENT FOR TOBACCO RETAIL <br />LICENSE COMPLIANCE INSPECTIONS <br />.~ <br />i <br />~~ ~ <br />C MANAG <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 1S` Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute the attached <br />agreement with the California State Department of Public Health for tobacco <br />license compliance checks and investigations in the amount of $75,000 for a <br />one-year term, subject to non-substantive changes approved by the City <br />Manager and City Attorney. <br />DISCUSSION <br />On October 16, 2006, Council adopted the Tobacco Retail License Ordinance <br />to Chapter 18 of the Santa Ana Municipal Code to strengthen existing <br />prohibitions against the unlawful sale, use, or distribution of tobacco and <br />to curb youth access to tobacco. Council also approved the establishment <br />of an annual tobacco retail license fee at $635 effective January 1, 2007. <br />Since the implementation of the ordinance, 286 retailers have complied with <br />the tobacco retail license requirement and the total fees collected is <br />$181,800.50. In order to fully implement the tobacco retail license <br />program, staff recommends execution of an agreement (Attachment 1) with the <br />California State Department of Public Health (CDPH) for a one-year term in <br />an amount not to exceed $75,000. CDPH will conduct investigations <br />throughout the City of Santa Ana to determine if tobacco retailers are in <br />compliance with the City's Tobacco Retail License Ordinance and with <br />California's Stop Tobacco Access to Kids Enforcement Act. CDPH will <br />conduct a minimum of 100 investigations at a rate of $460 per <br />investigation. <br />25M-1 <br />
