Conditional Use Permit No. 2007-23 <br />December 10, 2007 <br />Page 3 <br />Lastly, the project will provide improved pedestrian accessibility for <br />the building and site. A 10-foot wide walkway will lead directly from <br />the public sidewalk to the Bristol Street entrance. The existing <br />doorway on the south of the building will provide a clear path of travel <br />for patrons to and from the parking lot. Additionally, this side <br />entrance will be modified to discourage patrons from crossing through <br />the drive-through lane to enter and exit the restaurant. <br />Analysis of the Issues <br />As existing, the project site is currently non-conforming as the <br />property does not comply with the City's current development standards. <br />Section 41-681.2 of the Santa Ana Municipal Code (SANG) states that in <br />order to rehabilitate and expand a nonconforming building, the project <br />site must then comply with the all current development standards. <br />Therefore, site improvements must be made in order to expand the <br />existing commercial building. These improvements include items such as <br />additional landscaping, signage to meet code, meet building setbacks, <br />and obtain all required land use entitlements. <br />When originally built, the Carl's Jr. Restaurant was not required to <br />obtain a conditional use permit to operate the drive-through restaurant. <br />However, with the current expansion and remodel, the project must comply <br />with Section 41-365.5 (e) of the Santa Ana Municipal Code (SANG), which <br />requires an approved conditional use permit to operate a restaurant with <br />drive-through window service. An approved conditional use permit will <br />provide an avenue by which the City can ensure that the drive-through <br />operation will not negatively impact the surrounding properties. The <br />conditions applied to the project will ensure that the site remains as <br />approved by the City and conditions from the Police Department will <br />minimize the potential for criminal activity on the site. <br />The proposed expansion and remodel will bring the site up to compliance <br />with the City's current development standards. The site will comply <br />with the City's landscape requirements and 15-foot landscape setbacks <br />will be installed along both Bristol Street and Central Avenue. The <br />landscaping for the site will be installed to comply with the City's <br />commercial landscaping standards along with the South Bristol Street <br />Improvement Plan. Lastly, the exterior of the building will be <br />remodeled with a contemporary architectural style that is consistent <br />with the Citywide Design Guidelines and Urban Design Element. <br />31 C-4 <br />
