<br />RESOLUTION NO. 2008-002 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA CERTIFYING THAT THE CITY OF SANTA <br />ANA HAS THE RESOURCES TO FUND THE PROJECTS <br />SUBMITTED FOR INCLUSION IN THE FY 2008/09 - <br />2013/14 TRANSPORTATION IMPROVEMENT PROGRAM <br />AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL <br />OF THE PROJECTS SUBMITTED IN THE PROGRAM <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. The City of Santa Ana desires to include the submitted projects in the <br />Orange County Transportation Authority's (OCTA) Regional <br />Transportation Improvement Program (RTIP); and <br /> <br />B. The City of Santa Ana warrants that full funding is committed and <br />available for projects submitted for programming in the first four years (FY <br />2008/09 through FY 2011/12) of the RTIP; and that the City of Santa Ana <br />accepts responsibility for full funding of said projects and warrants that no <br />additional funding allocations are required of OCTA for the City of Santa <br />Ana to fully implement said projects therefore committing that the first four <br />years of the RTIP are financially constrained; and <br /> <br />C. Projects programmed in years 2012/13 - 2013/14 are projects expected to <br />receive future funding through anticipated revenues, therefore all projects <br />submitted for inclusion in the 2008 RTIP are financially constrained; and <br /> <br />D. OCTA as the agency responsible for short-range capital and service <br />planning and programming for the Orange County area, requires an <br />approved Resolution from the governing body of the Lead Agency for all <br />projects included in the Transportation Improvement Program; and <br /> <br />E. OCTA also requires that the Lead Agency include a financial plan that <br />demonstrates how the projects submitted for inclusion in the <br />Transportation Improvement Program can be implemented; and <br /> <br />F. The City of Santa Ana, as the Lead Agency, possesses the legal authority <br />to submit the project for inclusion in the Transportation Improvement <br />Program and to finance, acquire, and construct the project. <br /> <br />Section 2. The City Council of the City of Santa Ana hereby affirms its <br />continuing commitment to the projects submitted for inclusion in the 2008 Regional <br />Transportation Improvement Program as set forth in Exhibit A. <br /> <br />Resolution No. 2008-002 <br />Page 1 of 4 <br />
