Zoning Ordinance Amendment No. 2007-06 <br />Ordinance Amendment No. 2008-O1 <br />January 14, 2008 <br />Page 4 <br />goals and policies. Zoning regulations permit specific types of <br />compatible land uses and uses that have the potential to negatively impact <br />either adjacent neighborhoods or surrounding business require a <br />conditional use permit in commercial and industrial zoning districts. <br />Hookah parlors present the potential to expose neighboring business and <br />residences to health and safety impacts. The California Air Resources <br />Board classified secondhand smoke as a toxic pollutant that contributes to <br />death and illnesses among non-smokers. Since many of the commercial <br />buildings in the city are historic or constructed of flammable materials <br />and share common walls with other structures, secondhand smoke pollution <br />and the introduction of heated charcoal within or directly outside the <br />structure creates fire safety as well as toxic fumes impacts not only for <br />the employees but adjacent businesses and residences. <br />However, without regulating hookah parlors the city's commercial and <br />industrial zones are vulnerable to the same impacts as residential under <br />the zoning classification "retail and service uses" in the Santa Ana <br />Municipal Code Section 41-144 which may allow hookah parlors under this <br />broad definition. <br />Staff has determined that Hookah Parlors are not in the best interest of <br />public health and safety nor compatible with or supportive of surrounding <br />land uses in any zone. This analysis is based on the experiences of other <br />jurisdictions, and potential detrimental health effects to Santa Ana's <br />adjacent businesses, neighborhoods, and other sensitive land uses. <br />CEQA Compliance <br />In accordance with the California Environmental Quality Act, the <br />recommended action is exempt from further review.
