device owned and under the direct operational control of an employee of a Named Insured if such <br /> mobile device is used for the benefit of the Named Insured. <br /> Computer System also includes cloud computing and other hosted resources operated by a third <br /> party for the purpose of providing hosted computer resources to the Named Insured as provided in <br /> a written contract between the Named Insured and such third party. <br /> "Cyberterrorism" means the premeditated use of disruptive activities against any Computer <br /> System by an individual or group of individuals, or the explicit threat by an individual or group of <br /> individuals to use such activities, with the intention to cause harm, further social, idealogical, <br /> religious, political or similar objectives, or to intimidate any person(s) in furtherance of such <br /> objectives. Cyberterrorism does not include any such activities which are part of or in support of <br /> any military action, war or warlike operation. <br /> "Data Incident Response Expense" means reasonable and necessary fees and expenses <br /> incurred by an Insured, with the Company's prior written consent,for: <br /> 1. legal services by an attorney selected by the Company regarding any Network <br /> Security Breach or Privacy Violation; <br /> 2. computer forensic investigatory services by a third party information security <br /> professional selected by the Company to determine the cause of the Network <br /> Security Breach and identities of those who may have been victims of any Privacy <br /> Violation; <br /> 3. notifying individuals who may have been victims of any Privacy Violation; <br /> 4. public relations firm, crisis management firm or law firm services to mitigate <br /> reputational damage resulting from any Network Security Breach or Privacy <br /> Violation; <br /> 5. credit monitoring services and identity theft education; <br /> 6. costs for identity theft call center services; and <br /> 7. costs to restore or recreate electronic data; <br /> Data Incident Response Expense will exclude any: (i) compensation or overhead of any <br /> Insured; (ii) payments made as compensation for any injury or damages resulting from any <br /> Network Security Breach or Privacy Violation; or (iii) costs associated with replacing, <br /> repairing or improving any network, computer hardware or software. <br /> "Denial of Service Attack" means a malicious attack intended by the perpetrator to <br /> overwhelm the capacity of the Computer System by sending an excessive volume of <br /> electronic data to such Computer System in order to prevent authorized access to such <br /> Computer System. <br /> "Network Security Breach" means any: <br /> 1. unauthorized access to, or unauthorized use of, a Computer System; <br /> 2, transmission of Malicious Code into or from a Computer System; or <br /> 3.
