' INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />N-D(-oSf <br />CLERK OF COUNCIL <br />GATE: ~-15,08 <br />p : Pw (a~ o~ ro-Il <br />5-y-e~~ W <br />THIRD AMENDMENT TO <br />CONSULTANT AGREEMENT <br />THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on February 4, 2008, by and between METCALF & EDDY, a Delaware corporation <br />("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ("City"). <br />Recitals: <br />A. The parties entered into Agreement A-2005-077, dated April 4, 2005, (hereinafter <br />"said Agreement") by which Consultant has provided engineering services, including <br />preparing plans, specifications and construction inspection services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Services and Compensation to provide for additional services in <br />relation to the West Pump Station Upgrade. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 1, SCOPE OF SERVICES, shall be amended to provide that Consultant will <br />perform additional engineering services to address the City's Plan Check Review for <br />the West Pump Station Upgrade Project as follows: <br />Task 1 -Electrical and Instrumentation Related Work. <br />A. Consultant takes the following Exceptions to the Plan Check Review <br />comments: <br />1. Consultant will not accommodate City's request for added above- <br />grade pullboxes for ductbanks feeding well pumps. <br />2. Consultant will not modify the size or layout of the electrical room. <br />3. Consultant will not change its approach to showing wiring for <br />Chlorine Building. <br />B. Scope of Work <br />1. Change communications protocol design form Modbus to Devicenet <br />2. Implement the use of Unitronics V570 PLC <br />3. Relocate the transformer pad to a farther west location. The approval <br />of this relocation will be subject to SCE recommendations. <br />4. Relocated electrical panel to allow addition of a new door and door <br />switch. <br />5. Add a groundfault for incoming feeder <br />6. Address and incorporate all other review comments with plans and <br />specifications. <br />A-2008-033 <br />
