N-200B-020 <br />\~~ \NO?-'f-,: :_ I:\J~;> <br />~~. cl.e~Jf AIRVIEW REALTY FUND, LP <br />\)fl: ~ ~ ;:D <br />~<Q l\~~ <br />~ . ~~ ~ \,'Q~C!f' <br />o.~<' <br />February 14,2008 <br /> <br />City of Santa Ana Public Works <br />20 Civic Center Plaza <br />Santa Ana, CA 92702 <br /> <br />RE: 2830 South Fairview Street-License and Right of Entry <br /> <br />To Whom It May Concern: <br /> <br />Fairview Realty Fund, LP, owner, does hereby grant to the City of Santa Ana, a charter <br />city and municipal corporation duly organized and existing under the Constitution and <br />laws of the State of California, its officers, agents, employees, and representatives <br />(collectively referred to as the "City"), the right to enter the property located at 2830 <br />South Fairview Street, a proposed subdivision of Tract No. 1013 in the City of Santa <br />Ana, County of Orange, more specifically described in "Exhibit A", attached hereto and <br />incorporated herein by reference (the "property"), and hereby grants to the City a license <br />and Right of Entry for the following: <br /> <br />The right to enter and use the property for the purpose of inspection, which shall include, <br />but not limited to inspection of the proposed facilities to be constructed pursuant to City <br />of Santa Ana Grading/Water permit #50100745 (copy attached herein and made a part <br />hereof as Exhibit B). <br /> <br />The City hereby agrees not to unreasonably interfere with right of Fairview Realty Fund, <br />LP to the use or ingress and egress of the property. <br /> <br />The City agrees to indemnify and hold harmless, Fairview Realty Fund, LP from any <br />liability arising out of the City's exercise of this License and Right of Entry. The City <br />further agrees to repair any damage to said property caused by the exercise of this <br />License and Right of Entry at its sole cost and expense and to restore said property, in <br />which it existed prior to the use of the property by the City. <br /> <br />The rights herein granted to the City, are exclusive, and the City agrees not to assign, <br />transfer, lease, pledge, or otherwise dispose of its License and Right of Entry without the <br />prior express written approval of the undersigned.
