.• <br />.1 <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />J <br />JJi -/,Y, ,Ci y' <br />CLERK OF COU I <br />^ATF: FEB 2005 <br />o: LAG C2) <br />AMENDMENT TO <br />LEGAL SERVICES AGREEMENT <br />A- 2007 -282 <br />THIS AMENDMENT TO AGREEMENT is entered into on December 4, 2007 by <br />and between McCune & Harber, LLP ( "Attorneys ") and the City of Santa Ana, a charter <br />city and municipal corporation of the State of California ( "City "). <br />RECITALS: <br />A. The parties entered into that certain Legal Services Agreement #A- 2005 -099, dated <br />May 2, 2005, (hereinafter "said Agreement ") by which Attorneys have provided legal <br />services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the fee schedule of said agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Amendment to Agreement, the parties agree as follows: <br />1. Section 2, COMPENSATION, shall be amended to increase the maximum rate of <br />compensation to $175.00 per hour. Said Section 2 shall read in full as follows: <br />"City agrees to compensate Attorneys, and Attorneys agree to accept from City, as <br />and for payment in full for all of said services in regard to each such action, <br />compensation at a maximum rate of $175.00 per hour. The City shall reimburse <br />Attorneys for their actual and reasonable out -of- pocket expenses incurred within the <br />scope of services under this Agreement. Permissible expenses shall include long <br />distance telephone charges, travel (subject to prior approval by the City Attorney), <br />photocopying and fax charges, filing fees and other similar expenses that are usually <br />incurred in connection with legal representation. <br />Attorneys agree that without written consent of City, only the following attorneys and <br />paralegals shall be allowed to bill for services under this agreement: <br />Dana McCune <br />Stephen Harber <br />Garrett Hines <br />Kenton Moore <br />Maureen Grisanti <br />Jessica Gillette <br />
