1 (m) CONTRACTOR is aware of the provisions of Section 3700 of the California Labor Code which <br />2 requires every employer to be insured against liability for Workers' Compensation or be self-insured in <br />3 accordance with provisions of that code. CONTRACTOR will comply with such provisions and shall <br />furnish COUNTY satisfactory evidence that CONTRACTOR has secured, for the period of this Agreement, <br />4 <br />statutory Workers' Compensation insurance and Employers' Liability insurance with minimum limits of <br />5 <br />$1,000,000 per occurrence. <br />6 <br />(n) If CONTRACTOR fails to provide the insurance certificates and endorsements within seven (7) <br />7 days of notification by CEO/Risk Management or by DIRECTOR, award may be made to the next qualified <br />8 proponent. <br />9 (o) COUNTY expressly retains the right to require CONTRACTOR to increase or decrease <br />10 insurance of any of the above insurance types throughout the term of this Agreement. Any increase or <br />11 decrease in insurance will be as deemed by CEO/Risk Management as appropriate to adequately protect <br />12 COUNTY. <br />13 (p) COUNTY shall notify CONTRACTOR in writing of changes in the insurance requirements. If <br />CONTRACTOR does not deposit copies of acceptable certificates of insurance and endorsements with <br />14 <br />DIRECTOR incorporating such changes within thirty (30) days of receipt of such notice, this Agreement <br />15 <br />may be in breach without further notice to CONTRACTOR, and COUNTY shall be entitled to all legal <br />16 remedies. <br />17 (q) The procuring of such required policy or policies of insurance shall not be construed to limit <br />18 CONTRACTOR's liability hereunder or to fulfill the indemnification provisions and requirements of this <br />1 g Agreement. <br />20 (r) The County of Orange Certificate of Insurance and the Special Endorsement for the County of <br />21 Orange can be utilized to verify compliance with the above-mentioned insurance requirements in place of <br />commercial insurance certificates and endorsements. <br />22 <br />PATENT/COPYRIGHT MATERIALS/PROPRIETARY INFORMATION <br />23 <br />32. CONTRACTOR agrees to grant the COUNTY, Federal and State governments aroyalty-free, <br />24 <br />nonexclusive and irrevocable license to publish, copy, translate or use, now and hereafter, all materials, <br />25 data, films, tapes, etc., developed under this Agreement including those covered by copyright.
