REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 3, 2008 <br />TITLE: <br />RESOLUTION DECLARING THE <br />RESULTS OF THE FEBRUARY 5, 2008 <br />SPECIAL MUNICIPAL ELECTION <br />,/ ~~ <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 1S` Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Adopt a resolution declaring the results of the Special Election held in <br />the City on February 5, 2008. <br />DISCUSSION <br />On February 25, 2008, the Orange County Registrar of Voters certified the <br />results of the canvass of the Santa Ana Special Municipal Election returns <br />for Measures D and E. Pursuant to State Elections Code Sections 10264, the <br />City Council must adopt a resolution reciting the fact of the election and <br />the results of: (a) the whole number of votes cast in the City, (b) the <br />measures voted upon, (c) the number of votes by precinct, and (d) the <br />number of votes for or against the measures. The accompanying resolution <br />and Exhibit A identify the results of the balloting. <br />Measure D and E proposed amendments to the term limit provisions of the <br />City Charter. Pursuant to the provisions of California Government Code <br />Section 34459, these measures shall take effect after they are accepted and <br />filed by the Secretary of State. The Clerk of the Council will file the <br />necessary documents with the Secretary of State following the Council's <br />action on the resolution declaring the results of the election. <br />Additionally, a provision in Measure D requires the City Council to adopt a <br />Code of Ethics and Conduct for elected officials and members of appointed <br />boards, commissions, and committees within six months of the effective date <br />of the charter section. <br />FISCAL IMPACT <br />There is no fiscal impac associated with this action. <br />Patricia Healy <br />Clerk of the Council <br />55C-1 <br />
