<br />AGREEMENT BETWEEN THE COUNTY OF ORANGE AND THE ORANGE COUNTY
<br />FIRE AUTHORITY FOR USE OF LANDBASE SYSTEM
<br />This License Agreement ("Agreement") is made and entered into by and between
<br />the County of Orange {"County"),apolitical subdivision of the State of California, and
<br />the Orange County Fire Authority {"OCFA"), a California .loint Powers Authority,. as of
<br />December 5, 2007.
<br />RECITALS
<br />A. WHEREAS, the County is purchasing aCounty-wide, parcel level, digital
<br />land base .mapping .system (hereinafter "Landbase") from Southern California Gas
<br />__
<br />Company (SOCALGAS); and
<br />B. WHEREAS, OCFA desires to enter into a license with the County to
<br />access and use Landbase for the purpose of supporting public safety services, including
<br />planning, response and recovery throughout the County and to coordinate such efforts
<br />with other public safety agencies within the territorial boundaries of County ("Public
<br />Safety Agencies").
<br />C. WHEREAS, OCFA has been assigned by the Orange County Fire Chiefs
<br />Association as the Administrator for the Regional Public Safety GIS Cooperative
<br />consisting of Fire, Law Enforcement, and other public safety agencies, and has been
<br />authorized to enter into data use agreements on behalf of the members.
<br />NOW THEREFORE, for good and sufficient consideration, as set forth below, the
<br />parties agree as follows:
<br />Section 1. DEFINITIONS
<br />A. "Landbase" means the computer mapping system, which consists of
<br />County-wide, parcel level digital landbase, including any and all source code,
<br />modifications, derivative works, and any instructions, metadata, or software code that
<br />enables it to receive, manipulate, analyze, or display Source Data, and copies of the
<br />foregoing regardless of the form of the media in or on which they may exist.
<br />~' ~" ~" ` ~" B. "Source Data" means the land records (paper maps, written deeds; survey ~ - ~ °-~
<br />horizontal control and conversion quality control) and information contained therein,
<br />which the COUNTY provided and entered into Landbase.
<br />C. "Derivatives" shall mean all works created by OCFA, Public Safety
<br />Agencies, or subcontractors to OCFA or Public Safety Agencies, that are based upon
<br />and incorporated into all or part of the Landbase, including, but not limited to, a revision,
<br />modification, translation, abridgement, condensation, expansion, collection, compilation
<br />or any other form of data based on the Landbase.
<br />D. "Public Safety Agencies" shall mean local agencies located within the
<br />territorial boundaries of the County, which are detailed in Section 3, whose purpose is to
<br />provide the public with public safety services such as Fire Protection, EMS, Law
<br />Enforcement.
