FIRST AMENDMENT TO AGREEMENT THIS FIRST AMENDMENT TO AGREEMENT is entered into on April, 2008, by and between Hydroblast Exterior Cleaning Company, LLC ("Contractor") and the City of Santa Ana ("City"). RECITALS: A. The parties entered into Agreement #A-2007-111 dated May 7, 2007, (hereinafter "said Agreement") by which Contractor has provided pavement cleaning services. B. The parties wish to correct a clerical error set forth in the TERM of said Agreement in order to bring the written document into conformance with the original agreement of the parties. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Service Agreement, the parties agree as follows: Section 3, TERM, shall be deleted in its entirety and replaced with the following: "This Agreement shall commence on the date first written above and terminate on May 31, 2009, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended for three additional one-year terms at the City's option. City may terminate this Agreement if the Santa Ana City Council fails to approve funding for said services during any fiscal year." 2. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect.
