SCOPE OF SERVICES I . Consultant shall provide gymnastics lessons which will teach basic gymnastics movements including basic tumbling, body movement, floor exercises, and flexibility training. Each class will include a warm up/stretching component and a cool down component. 2. This class meets at Jerome Center Gym on Mondays and Wednesdays from 5:OOpm- 6:00pm for Beginners, and from 6:00-7:OOpm for Intermediate/Advanced students. 3. If Consultant allows others to teach his/her class, those teachers must be over 21, have obtained and maintain an instructor rating, and be covered by Consultants' insurance. Consultant shall provide City with documentation to verify instructor and insurance requirements. CLASS SIZE 1. Each Gymnastics class must have a minimum of 5 paid students and no more than a maximum of 40 students. 2. If the minimum registration is not reached by the second class, the class may be cancelled by mutual agreement of Consultant and City, without any compensation owed to consultant. CLASS FEES 1. Each class participant shall pay a registration fee of $25.00 per monthly session. 2. No refunds shall be made to participants after the first week of class unless the Parks, Recreation, and Community Services Agency cancels the class. 3. The City shall collect the class fees from each participant during the registration period. Consultant shall not collect fees, but shall refer all interested participants to City for registration. 4. City agrees to pay Consultant seventy per cent (70%) of the total fees within fifteen (15) working days after completion of the class session. City and Consultant agree that City shall retain thirty per cent (30%) of the fees collected. 5. Consultant agrees that City representative shall be entitled to audit Consultant's records to insure compliance with this Agreement. 6. Consultant may not waive class participation/registration fees. 7. City shall prepare class rosters and provide a copy to Consultant. Only registered participants may participate in class.
