INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />DATE: 5~ ~~~6 <br />D ~ C~4~~ Clerk (z~ <br />t~; +~ G . <br />FIRST AMENDMENT TO <br />FEE AGREEMENT <br />THIS FIRST AMENDMENT TO FEE AGREEMENT, is entered into on May 29, <br />2008, by and between JAMS Orange Resolution Center ("JAMS") and the City of Santa <br />Ana, a charter city and municipal corporation of the State of California {"City"). <br />N-2008-037-01 <br />RECITALS: <br />A. The parties entered into Agreement # N-2008-037, dated Apri17, 2008, (hereinafter <br />"said Agreemenf~ by which JAMS has provided neutral evaluation hearing officer <br />services for the City. <br />B. Due to a lengthier than expected hearing, the fees for services provided exceed that <br />approved by the City. <br />C. The City desires to increase Compensation to pay the increased fees. <br />WHEREFORE, in consideration ofthe covenarrts contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />1. Total Fees shall be amended to increase the total fee available for neutral evaluation <br />services to an amount not to exceed $5,000,00. <br />2. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />IN WITNESS WFIEREOF, the parties hereto have executed this First Amendment to <br />Consultant Agreement on the date and year first written above. <br />CITY OF SANTA ANA <br />ATTEST: <br />yP TRICIA .
