On September 15, 1999 HUD adopted i mplememti ng regul ati ons to Title X that became <br />effective September 15, 2000 as set forth in 24 CFR Part 35, et seq. ("LBP Regs") which establish <br />specific rules regarding notification to owners and occupants about the existence of LBP hazards, <br />identification of LBP hazards, and control of LBP hazards; and <br />G. Residential structures built after January 1, 1978 we exempt from lead-based paint <br />requirements as the use of lead-based pant was banned for use in residences after this date by <br />Congress (24 CFR Part 35.115). Therefore, the Title X requirements set forth herein shall not be <br />applicable if the structures involved were bui I t after January 1, 1978. <br />H. Subpart K - Acquisition, Leasing, Support Services, and Operation of the LBP Regs, <br />sets forth specific requirements relating to housing provides, such as SUBRECI R ENT, who <br />administer local programs that provide supportive housing for special needs populations and are <br />funded by HUD Office of Community Planning and Development ("CPD") programs, including <br />CDBG furxls, as provided to SUBRECI R ENT under thi s Agreernent; and <br />I . I n connection wi th the grant of funds under this Agreement, Cl TY requi res that <br />SUBRECI R ENT comply and evidence of compliaiee with all applicable requireme is of Title X <br />and the LBP Regs, in parti cul ar Subpart K relating to aequi siti on, leasing, support services, or <br />operati ons, and Subpart J rel ati ng to rehabi I i tail on, as and when appl i cabl e; and <br />J. In connection with the grant of funds under this Agreement, CITY requires that <br />SUBRECI R ENT comply and show evidence of compl i anee with ail applicable requirements of <br />Titl e X and the L BP Regs, in particul ar Subpart M relating to tenant based rental assists -e, as and <br />when "icable, and <br />K. Attached and hereby fully incorporated to this Agreement are the following notification <br />attachments Attachment No. 1 entitled "Protect Your Family From Lead In Your HomLe, <br />EPA747-K-99-001, Attachment No. 2 entitled "Sample Disclosure Format for Target Housing <br />Sales, Disclosure of Information on Lead -Based Pant and Lead -Based Paint Hazards°, and <br />Attachment No. 3 entitled Sample Summery Risk Assessment Notice Format"; provided however, <br />that such attachments are not intended to modify or limit SUBRECI R ENT' S obligation to fully <br />comply with ail appl i cable Provi si ons of Title X and the i mPleme ti ng regulations i n the L BP Regs; <br />and <br />L. By this Agreement SUBRECIRENT will accept assignment from the CITY of all <br />responsi bi I iti es set forth i n Subpart K of the L BP Regs; and <br />M. The CITY and SUBRECI RENT have duly executed thisAgreernemt for the expenditure <br />of such funds; and <br />2 <br />
