Residential structures bui 1 t after January 1, 1978 are exempt from lead-based paint re- <br />quirements, as the use of lead-based paint was banned for use in residences after this date by <br />Congress (24 CFR Part 35.115). Therefore, the Title X requirements set forth herein shall not <br />be appl i cabl e i f the structures i nvol ved were bui I t after January 1, 1978. <br />8. Subpart K - Acquisition, Leasing, Support Services, and Operation of the LBP Regs, sets <br />forth sped fi c requi rements rel ati ng to housi ng provi ders, such as SU BRECI PI ENT, who admi - <br />ni ster local programs that provide supportive housing for special needs popul ati ons and are <br />funded by H UD Offi ce of Community PI anni ng and Devei opment ("CPD") programs, i nd udi ng <br />ESG funds, as provi ded to SU BRECI PI ENT under thi s Agreement; and <br />9. 1 n connection with the grant of funds under this Agreement, CITY requi res that <br />SU BRECI PI ENT comp) y and show evi denoe of comp) i ance wi th al I appl i cabs a requi rements of <br />Ti tl e X and the L BP Regs, i n parti cul ar Subpart K rel ati ng to acqui si ti on, I easi ng, support ser - <br />vi ces, or operati ons, and Subpart J rel ati ng to rehabi I i tati on, as and when appl i cabl e; and <br />10. In connection with the grant of funds under this Agreement, CITY requires that <br />SU BRECI PI ENT comply and show evidence of compliance with ail appl i cable requirements of <br />Title X and the LBP Regs, in parti cul ar Subpart M relating to tenant based rental assistance, as <br />and when appi i cable; and <br />11. Attached and hereby fully incorporated to this Agreement are the fol i owi ng notification <br />attachments: Attachment No. 1 entitled "Protect Your Family From Lead In Your Home', <br />EPA747-K-99-001, Attachment No. 2 entitled "Sample Disclosure Format for Targe Housing <br />Sales, Disclosure of Information on Lead -Based Pant and Lead -Based Paint Hazards°, and At- <br />tachment No. 3 entitled "Sample Summary Risk Assessment Notice Format"; provided however, <br />that such attachments are not intended to modify or limit SUBRECIPIENT'S obligation to fully <br />comp) y wi th al I appl i cabl a provi si ons of Ti tl e X and the i mpl emeriti ng regul ati ons i n the L BP <br />Regs and <br />12. By thi s Agreement SU BRECI PI ENT wi I I accept assignment from the CI TY of al I respon <br />si bi I iti es set forth i n Subpart K of the L BP Regs; and <br />13. SU BRECI PI ENT agrees that it wi I I adhere to the performance measurements and out- <br />comes as indicated on Exhibit A-1 (Outcome Tracking). Fai I ure to fol I ow the measurements and <br />meet the stated outcomes may constitute breach of contract that coul d resul t i n termi nati on of <br />thi s Agreement or serve as reason for the Ci ty to recapture the grant funds awarded to <br />SU BRECI RENT pursuant to this Agreement. <br />14. The CITY and SU BRECI PI ENT have duly executed this Agreement for the expenditure <br />of such funds; and <br />2 <br />
