I n accordance with 42 USC 11375(a), SUBRECI PI ENT agrees to match al I federal funds provided by CITY to SUBRECIRENT with an equal amount of funds from sources other than these or other ESG funds. SUBRECI RENT cannot use ESG funds from other jurisdictions in order to meet this match requirement. Match documentation showing new, previously unused match dol I ars, must be provided with each quarterly report. C. SUBRECI R ENT'S failure to perform as required may, in addition to other remedies set forth in this Agreement, result in readjustment of the amount of funds CITY is otherwise obl i gated to pay to SUBRECI R ENT pursuant to the terms hereof. SUBRECI R ENT agrees that the homeless shelter and cervi ces under sai d program shat I be made avai I abl a for the enti re peri od dud ng whi ch sai d funds are provided. D. Allawable Costs SUBRECIR ENT agrees to complete said program on or before and to use said funds to pay for necessary and reasonabie costs allowable under the federal law and regulations to operate said program. Said amounts shall include esseriti al cervices, homeless prevention, and/or operations costs Other allowable program costs are detailed in the Budget, as set forth in "Exhibit B," attached hereto and by this reference incorporated herein. SU BRECI R ENT shall use all income received from said funds only for the same purposes for which said funds may be expended pursuant to the terms and condi ti ons of this Agreenheht. E. Li cens ng. SU BRECI R ENT agrees to obtain and maintain all required licenses, regi straaii ons, accreditation and i nspecti ons from all agencies governing its operations, SUBRECI R ENT shall ensure that its staff shall also obtain and maintain all required I i tenses, regi strati ons, accreditation and i nspec tii ons from all agencies governing SU BRECI R ENT's operations hereunder. Such licensing requirements include obtaining a City business I i cert as C F. Zoning- SUBRECI R ENT agrees that any facility/property used in furtherance of said program shall be specifically zoned and permitted for such use(s) and activity(ies). Should SUBRECI R ENT fail to have the required land entitlement and/or permits, thus violating any I ocal , state or federal rules and regulations relating thereto, SUBRECI R ENT shall immediately make good -faith efforts to gain compliance with local, state or federal rules and regulations fol lovvi ng written notification of said violation(s) from the CITY or other authorized citing agency. SUBRECI R ENT shall notify CITY immediately of any pending violations, FaiI ure to notify CITY of pending vi olati ons, or to remedy such known violation(s) shall result in termination of grant funding hereunder. SU BRECI R ENT must make ail corrections required to bring the fat I ity/property into compliance with the law within sixty (60) days of notification of the
