INSURANCE ON FILE WORK MAY PROCEED UNTIL INSURANCE EXPIRES CLERK OF COUNCIL DATE: (o_ 30 -oii N-2008-073 (� THIRD AMENDMENT TO C `Par V's R Pa C- (2.� CONSULTANT AGREEMENT THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is made and entered into this 30'h day of May, 2008, between Orange County Children's Therapeutic Arts Center, a Non -Profit Public Benefit Corporation (hereinafter "Consultant") and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). RECITALS: A. City and Consultant entered into Agreement N-2006-024 dated December 22, 2005, hereinafter referred to as "said Agreement" by which Consultant provides music and art classes. B. In accordance with the terms and conditions of said Agreement, the parties wish to renew the said Agreement for an additional one-year period, amend the Scope of Services to provide for additional classes and increase available compensation to pay for the additional classes. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Third Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the following: "Consultant shall instruct Music, Dance and Arts classes for the City's leisure class program as set forth in Exhibit A-1 attached to this Third Amendment to Agreement." 2. Section 2.a., COMPENSATION, shall be amended to increase compensation by $10,000 for a total amount not to exceed $20,000 during the Term of said Agreement. 3. Paragraph 3, TERM of said Agreement shall be amended to extend the Term to June 30, 2009. 4. Except as hereinabove amended the terms and conditions of the said Agreement shall remain in full force and effect.
