INSURANCE N07 REQUIRED - (~ COPY N'2005-066-02 <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />Dam' SECOND AMENDMENT TO AGREEMENT <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into on July 1, 2008, by <br />and between Orchard Supply Hazdwaze ("OSH") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into Agreement N-2005-066, dated May 24, 2005, (hereinafter "said <br />Agreement") by which OSH has participated in a voucher purchase program for its "Back <br />Yard Composter Bin". <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to increase <br />compensation available for the voucher program and to extend the term of said Agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to <br />all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Agreement, the parties agree as follows: <br />1. The City shall allocate $15,000.00 to reimburse OSH for vouchers redeemed by City <br />residents during the 2008-09 fiscal year. <br />2. ;Section 3, TERM, shall be amended to extend the termination date to June 30, 2009. <br />3.
