<br />including, but not limited to, grading, clearing, removal of debris, the <br />installation or construction of curbs, gutters, walls, sidewalks or <br />paving, or water, irrigation, drainage or electrical facilities; <br /> <br />(b) "Services" means the furnishing of services and materials for the ordinary <br />and usual maintenance, operation, and servicing of any Improvement, including: <br /> <br />(1) repair, removal, or replacement of any part of the Improvement; <br /> <br />(2) providing for the life, growth, health and beauty of landscaping <br />including cultivation, irrigation, trimming, spraying, fertilizing, or <br />treating for disease or injury; <br /> <br />(3) the removal of trimmings, rubbish, debris and other solid waste; <br /> <br />(4) the cleaning, sandblasting and painting of walls and other <br />improvements to remove or cover graffiti; <br /> <br />(5) providing security, sanitation, graffiti removal, street cleaning and <br />other municipal services supplemental to those provided by the <br />City. <br /> <br />(c) "Activities" means, but is not limited to, all of the following: <br /> <br />(1) promotion of public events which benefit businesses, tenants or <br />real property in the district; <br /> <br />(2) furnishing of music and/or entertainment in any public place within <br />the district; <br /> <br />(3) promotion of tourism within or benefiting the district; <br /> <br />(4) marketing and economic development, including, but not limited to, <br />business retention and recruitment; <br /> <br />(c) "Owners Association" means a private nonprofit corporation registered <br />and in good standing with the California Secretary of State that is under contract with <br />the City to administer or implement services, activities and improvements specified in <br />the management district plan. An Owners Association may be existing or newly formed. <br />An Owners Association is a private entity and shall not be considered a public entity for <br />any purpose, nor shall its board members or staff be considered to be public officials for <br />any purpose. Notwithstanding the foregoing, an Owners Association when under <br />contract with the City to manage the district shall comply with the Ralph M. Brown Act <br />(Chapter 9 (commencing with Section 54950) of Part 1 of Division 2 of Title 5 of the <br /> <br />Ordinance No. NS-2771 <br />Page 3 of 12 <br />
